Article 1. Identity of the trader

1.1. TS Supplies is a sole proprietorship established in Barendrecht, the Netherlands.

1.2. TS Supplies operates, among other things, the website: www.ts-shootingsupplies.com.

1.4. In these terms and conditions, TS Supplies is also referred to as: 'TS Supplies', 'we' or 'us'.

 

 Article 2. Definitions

In these terms and conditions, the following definitions apply:

2.1.             Consumer: the natural person acting for purposes which are outside that person's trade, business, craft or profession.

2.2.             Contract: any distance contract between TS Supplies and the consumer concluded through the webshop or otherwise at a distance.

2.3.             Product(s): all goods and, where applicable, digital content or related services offered by TS Supplies.

2.4.             Right of withdrawal: the consumer's statutory right to withdraw from the distance contract within the cooling-off period.

2.5.             Special-order products: products that are purchased or ordered separately at the consumer's request outside the regular stock range. This does not automatically mean that the right of withdrawal is excluded; that depends on the statutory exceptions.

2.6.             Dual-use items: goods, software and technology that may be used for both civil and military purposes or are otherwise regulated, as referred to in applicable laws and regulations.

Article 3. Applicability and language

3.1. These terms and conditions apply to all offers, orders and contracts between TS Supplies and consumers.

3.2. TS Supplies sells exclusively to consumers. TS Supplies may refuse or cancel orders if it reasonably appears or is suspected that the order is business-to-business/B2B in nature, or that these terms and conditions or applicable laws and regulations are not being complied with.

3.3. Deviations from these terms and conditions are valid only if they have been expressly confirmed by TS Supplies in writing or electronically.

3.4. TS Supplies provides these terms and conditions only in Dutch and English.

3.5. In the event of any difference in interpretation between the Dutch and English versions, the Dutch version shall prevail, unless mandatory law provides otherwise.

3.6. If any provision is found to be null and void or voidable, the remaining provisions shall remain in full force and effect. In that event, TS Supplies and the consumer shall apply a replacement provision that corresponds as closely as possible to the purpose and intent of the original provision.

Article 4. Offer and product information

4.1. TS Supplies takes care to provide product descriptions that are as complete and accurate as possible, including images, specifications and applicable restrictions.

4.2. Images, colours, dimensions, technical specifications and product descriptions on the website are indicative only. Obvious mistakes, typographical errors, pricing errors or technical errors shall not bind TS Supplies.

4.3. Offers remain valid while stocks last, unless expressly stated otherwise.

4.4. TS Supplies may amend or withdraw offers in the event of obvious mistakes, incorrect price displays, stock errors, technical malfunctions or changed legal restrictions.

4.5. Certain products may be subject to additional legal restrictions, export rules, end-use restrictions or licensing requirements. TS Supplies may include this information on product pages, but the absence of such a statement does not mean that such rules do not apply.

Article 5. Formation of the contract and verification checks

5.1. The contract is concluded at the moment TS Supplies confirms the consumer's order by email (order confirmation) or otherwise accepts it in an unequivocal manner.

5.2. TS Supplies may refuse an order before acceptance or suspend/correct it after acceptance if:

a.   the product is no longer available;

b.   there is an obvious error in price, specification or availability;

c.   legal or compliance restrictions prevent delivery;

d.   the consumer does not meet payment obligations;

e.   there are well-founded reasons to suspect abuse, fraud, sanctions risks or export risks;f. the order is in fact a business order.

5.3.             TS Supplies may perform verification checks. In that context, insofar as reasonable and legally permitted, TS Supplies may request additional information or documentation, such as identity information, delivery information, end-use information or end-destination information.

5.4.             If the consumer does not provide the requested information, does not provide it in time, or provides incomplete information, TS Supplies may suspend performance of the contract or refuse/cancel the order.

5.5.             TS Supplies is not obliged to explain in full the substance of compliance signals, screening results or risk assessments to the extent that doing so could undermine the effectiveness of controls, legal obligations or security interests.

5.6.             Special-order products may, after acceptance by TS Supplies, no longer be cancelled free of charge before dispatch. TS Supplies will indicate on a case-by-case basis whether cancellation is still possible and under what conditions, subject to the statutory right of withdrawal after delivery where applicable.

 

Article 6. Prices, costs and payment

6.1.   All prices on the website are stated in euros (EUR) and include VAT, unless expressly stated otherwise.

6.2.   Shipping costs, any payment surcharges (where permitted) and other costs will be clearly shown to the consumer before the order is placed.

6.3.   TS Supplies accepts the following payment methods (insofar as offered on the website):

iDEAL (via Mollie), credit card, PayPal and bank transfer.

6.4.   TS Supplies does not accept cash payments.

6.5.   TS Supplies may impose additional conditions for certain payment methods, such as address verification, additional checks or payment prior to dispatch.

6.6.   If a payment is reversed, refused or proves to be fraudulent, TS Supplies may suspend delivery or terminate the contract, without prejudice to any other rights.

 

Article 7. Delivery, delivery periods and delivery area

7.1.   TS Supplies dispatches from the Netherlands.

7.2.   TS Supplies delivers within the Netherlands and, insofar as offered, within the European Union. TS Supplies may restrict or expand the delivery area at any time.

7.3.   TS Supplies may limit delivery territories and communicates available destinations on the website.

7.4.   If delivery outside the EU is offered in the future, additional conditions may apply, including customs formalities, import restrictions, export licences, end-user declarations, taxes, import duties, local licences or additional verifications.

7.5.   Delivery periods are indicative, unless a strict deadline has expressly been agreed in writing.

7.6.   TS Supplies shall deliver without undue delay and, in principle, within the statutory period, unless another delivery period has been agreed or special circumstances (such as a special order, licensing procedure, customs inspection or force majeure) justify a longer period.

7.7.   If a product cannot be delivered, or can only be delivered in part, TS Supplies shall inform the consumer thereof as soon as possible. In that case TS Supplies may: (a) offer an alternative product; (b) postpone delivery; or (c) cancel the contract in whole or in part and reimburse amounts already paid for the undelivered part.

7.8.   In a consumer sale, the risk of damage to or loss of a product passes to the consumer at the moment of actual receipt by the consumer or by a third party designated by the consumer (other than the carrier), unless the consumer has chosen a carrier not offered by TS Supplies.

7.9.   The consumer must inspect the product as soon as reasonably possible upon receipt for visible damage or discrepancies and report any problems to TS Supplies within a reasonable period.

Article 8. Right of withdrawal (14 days)

8.1. The consumer may withdraw from a distance contract concerning the purchase of a product during a cooling-off period of 14 days without giving any reason.

8.2. The cooling-off period starts on the day after the consumer, or a third party designated by the consumer (other than the carrier), has received the product.

8.3. During the cooling-off period, the consumer must handle the product and packaging with care. The consumer may use and inspect the product only to the extent necessary to establish the nature, characteristics and functioning of the product, as would be permitted in a physical shop.

8.4. If the consumer exercises the right of withdrawal, the consumer shall notify TS Supplies within the cooling-off period by means of an unequivocal statement (for example by e-mail) or by using the model withdrawal form (see Appendix 1).

8.5. After notification of withdrawal, the consumer will, where necessary, receive instructions for the return shipment.

Article 9. Exceptions to the right of withdrawal

9.1. The right of withdrawal does not apply to contracts and products for which the law provides an exception.

9.2. Examples of statutory exceptions (where applicable) include, among others:

a. products made to the consumer's specifications, which are not prefabricated and are manufactured on the basis of an individual choice or decision of the consumer; b. products clearly intended for a specific person;

c.   sealed products which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

d.  products which, after delivery, are irrevocably mixed with other products by their nature;

e.  audio or video recordings or computer software supplied in sealed packaging, where the seal has been broken;

f.   the supply of digital content not supplied on a tangible medium, if performance has begun with the consumer's prior express consent and the consumer has declared that they thereby lose the right of withdrawal;

g.  any other statutory exceptions applicable at that time.

9.3. The mere fact that a product was 'ordered especially for you' or was 'not in stock' does not automatically mean that the right of withdrawal is excluded. Exclusion applies only if a statutory exception is in fact met.

Article 10. Returns, depreciation and reimbursement

10.1. After withdrawal, the consumer must return or hand over the product to TS Supplies without undue delay and, in any event, within 14 days after the withdrawal notice.

10.2. Unless TS Supplies expressly indicates otherwise, the direct costs of returning the product shall be borne by the consumer.

10.3. Return shipment takes place at the consumer's risk until TS Supplies has received the product. TS Supplies recommends using a shipping method with track & trace.

10.4. The consumer must, insofar as reasonably possible, return the product in its original packaging, including accessories, manuals and supplied components. Missing or damaged packaging does not automatically lead to loss of the right of withdrawal, but may be relevant to the assessment of depreciation.

10.5. The consumer is liable only for any depreciation in value of the product resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.

10.6. TS Supplies shall reimburse all payments received from the consumer in relation to the withdrawn product, including the standard delivery costs for the outward shipment (insofar as legally required), without undue delay and no later than 14 days after the day on which TS Supplies received the withdrawal notice.

10.7. TS Supplies may withhold reimbursement until: (a) the returned product has been received; or (b) the consumer has supplied evidence that the product has been returned, whichever occurs first.

10.8. If the consumer has expressly chosen a method of delivery that is more expensive than the cheapest standard delivery offered by TS Supplies, TS Supplies is not required to reimburse the additional costs of the more expensive delivery.

10.9. As a gesture of goodwill, TS Supplies may reimburse (part of) the return costs for an order. This does not create any entitlement for future orders.

10.10. If a return concerns non-conformity or an error attributable to TS Supplies, reasonable return costs shall be borne by TS Supplies, insofar as legally required.

Article 11. Statutory conformity, product complaints and remedies

11.1. TS Supplies warrants that products conform to the contract, to the reasonable expectations the consumer may have of them, and to the applicable statutory conformity requirements.

11.2. The consumer is requested to inspect the product within a reasonable period after receipt and to report any visible defects, transport damage or inaccuracies to TS Supplies as soon as possible.

11.3. A report by the consumer should contain as clear a description of the problem as possible, preferably including photographs, the order number and contact details, so that TS Supplies can assess the complaint.

11.4. In the event of a justified complaint regarding non-conformity, TS Supplies shall, in accordance with the law, provide repair or replacement free of charge, unless this is impossible or cannot reasonably be required from TS Supplies.

11.5. If repair or replacement is not possible or is not carried out within a reasonable time, the consumer shall have the statutory rights to a price reduction or termination of the contract, insofar as the legal requirements are met.

11.6. If investigation shows that: (a) no defect is present; (b) the complaint was caused by incorrect use, careless use, incorrect assembly, wear and tear, accident, an external cause or non-compliance with instructions; or (c) the defect falls outside the statutory conformity obligation or commercial guarantee, then TS Supplies may charge reasonable inspection, shipping or handling costs, provided this is communicated in advance or as soon as possible thereafter.

11.7. This article does not affect any mandatory consumer rights.

Article 12. Commercial guarantee of manufacturer/supplier

12.1. In addition to statutory conformity (Article 11), certain products may be covered by commercial guarantees offered by the manufacturer or supplier.

12.2. Such commercial guarantees are not independently granted by TS Supplies. The content, duration, conditions, exclusions and handling of those guarantees are based on the provisions of the manufacturer and/or supplier.

12.3. TS Supplies shall, insofar as reasonably possible, inform the consumer of the applicable guarantee conditions if these are known to TS Supplies or have been made available by the manufacturer/supplier.

12.4. A commercial guarantee from a manufacturer or supplier never limits or replaces the consumer's statutory rights based on conformity.

12.5. For the handling of a guarantee claim, TS Supplies may request the consumer to submit the product for inspection or to follow an RMA/return procedure.

 

Article 13. Liability

13.1. TS Supplies is liable only for direct damage that is the direct result of an attributable failure in the performance of the contract, insofar as such liability is not excluded or limited by law.

13.2. TS Supplies is not liable for indirect damage, consequential loss, loss of profit, loss of savings, non-material damage, business interruption (where applicable) or damage caused by data loss, unless there is intent or deliberate recklessness on the part of TS Supplies or the damage results from mandatory law.

13.3. TS Supplies is not liable for damage resulting from: (a) incorrect, unsafe or improper use of the product; (b) use contrary to instructions, warnings or applicable laws and regulations; (c) modifications, repairs or alterations by the consumer or third parties without TS Supplies' permission; (d) normal wear and tear or external causes.

13.4. Insofar as TS Supplies is liable, liability is limited to the amount paid out in the relevant case by TS Supplies' liability insurer. If no insurance payment is made, liability is limited to the amount paid by the consumer for the relevant product, unless mandatory law provides otherwise.

13.5. The limitations in this article do not apply to liability arising from: (a) intent or deliberate recklessness on the part of TS Supplies; (b) death or personal injury; (c) product liability insofar as mandatory law applies; (d) any other liability that cannot be excluded or limited under mandatory law.

13.6. For delays, refusals or cancellations resulting from export control, sanctions rules, licensing requirements, customs decisions or decisions of public authorities, Articles 14 and 15 apply in addition.

Article 14. Export control, sanctions and compliance

14.1. TS Supplies dispatches products from the Netherlands and operates in accordance with applicable Dutch, European and, where relevant, international laws and regulations relating to export control and sanctions.

14.2. Delivery to, or for the benefit of, countries, regions, persons, entities or end users for whom a prohibition, restriction or licensing requirement applies may be refused, suspended or cancelled in whole or in part.

14.3. TS Supplies does not maintain a static list of destinations in these terms and conditions. Sanctions and export restrictions change regularly. Therefore, the most current applicable laws and regulations and/or decisions of competent authorities shall always apply.

14.4. In assessing orders, TS Supplies may use screening, verification and risk assessment, including checks on: (a) destination and delivery address; (b) identity of the purchaser and/or recipient; (c) end use and end user; (d) product classification; (e) indications of (re-)export or transit; (f) applicable sanctions or export restrictions.

14.5. At first request, the consumer is obliged to provide correct, complete and verifiable information in a timely manner, insofar as reasonably necessary for compliance and export assessment.

14.6. TS Supplies may refuse, suspend or cancel an order if: (a) delivery would be contrary to laws or regulations; (b) a required licence or approval is missing, refused or delayed; (c) the consumer provides insufficient information; (d) TS Supplies identifies a reasonable compliance risk or circumvention risk; (e) there are indications of resale, re-export or end use contrary to applicable rules.

14.7. In the event of cancellation under this article, TS Supplies shall refund payments already received for the undelivered product. In that case, save where mandatory law provides otherwise, TS Supplies shall not be liable for indirect damage or additional compensation.

14.8. TS Supplies may impose additional conditions on the delivery of regulated or potentially regulated products and accessories, including the signing of declarations regarding end use, end destination or re-export.

14.9. The consumer is responsible for complying with the laws and regulations of the country of destination and, where applicable, the country of subsequent import, use, re-export or transfer.

14.10. The fact that a product is visible on the website or can be ordered does not automatically mean that delivery to every destination is permitted.

14.11. References on the website or in communications to sanctions lists, sanctions maps or government information (such as EU/NL sources) are for information purposes only; the underlying applicable regulations, legislation and decisions of competent authorities shall prevail.

Article 15. Dual-use items, military items and licences

15.1. This article applies to products currently or in the future offered by TS Supplies that may fall under rules concerning: (a) dual-use items; (b) military items; (c) strategic goods or services; (d) products subject to export or end-use restrictions imposed by the manufacturer, supplier or country of origin; (e) related accessories or parts.

15.2. TS Supplies may classify products or have them classified based on information from the manufacturer, supplier, distributor, importer or competent authorities. A classification may change.

15.3. Certain products may require an export licence, notification obligation or other approval (for example through the CDIU or other competent authorities). The issuance, duration and outcome of such procedures are beyond TS Supplies' control.

15.4. Any delivery periods for products requiring a licence, assessment or additional compliance check are expressly indicative.

15.5. TS Supplies is not liable for delay or non-delivery resulting from: (a) licence applications or refusals; (b) additional checks by Customs/CDIU or other authorities; (c) changed classifications; (d) changed laws and regulations; (e) restrictions imposed by the manufacturer/supplier or exporter.

15.6. If a product or transaction is subsequently found to require a licence, or if delivery is otherwise not permitted, TS Supplies may suspend or terminate/cancel the contract in whole or in part.

15.7. Before proceeding with delivery, TS Supplies may require the consumer to sign or provide an end-user statement, a non-re-export declaration or other compliance documentation.

15.8. The consumer declares that products will not be used, supplied onward, transferred or re-exported in violation of applicable sanctions or export rules, including any product-specific or manufacturer-specific restrictions made known before or upon delivery.

15.9. Insofar as the consumer exports, transfers or re-exports after delivery, this is entirely the consumer's responsibility. The consumer must independently verify which licences, restrictions or prohibitions apply.

Article 16. Force majeure

16.1. TS Supplies is not obliged to perform any obligation if performance is prevented by force majeure.

16.2. Force majeure includes, among other things: disruptions of internet or payment traffic, cyber incidents, transport problems, delays at suppliers, import/export restrictions, customs inspections, licensing delays, government measures, sanctions changes, strikes, illness, fire, war, civil unrest, natural disasters and any other circumstances beyond TS Supplies' reasonable control.

16.3. During force majeure, TS Supplies' obligations shall be suspended. If performance becomes permanently impossible or the force majeure situation lasts an unreasonably long time, TS Supplies may terminate the contract in whole or in part.

16.4. In the event of termination due to force majeure, TS Supplies shall refund payments already received for the unperformed part of the contract, unless a statutory exception applies.

Article 17. Retention of title

17.1. All products delivered by TS Supplies remain the property of TS Supplies until the consumer has paid all amounts due in full.

17.2. Until title has passed, the consumer may not pledge the product or otherwise encumber it.

17.3. This article does not affect the statutory rules regarding the passing of risk in a consumer sale.

Article 18. Personal data and tax retention obligations

18.1. TS Supplies processes personal data in accordance with applicable privacy legislation (including the GDPR) and the privacy statement published on the website.

18.2. TS Supplies uses personal data for, among other things, order processing, payment, delivery, customer service, complaint handling, fraud prevention, compliance and verification checks (including export/sanctions), and compliance with legal obligations.

18.3. For details about categories of personal data, purposes, legal bases, retention periods, data subject rights and contact options, TS Supplies refers to the privacy statement.

18.4. TS Supplies retains administrative records, including order and invoice data, for as long as necessary for the performance of the contract and insofar as required under tax and administrative record-retention obligations. Certain data are in principle subject to a statutory retention period of at least 7 years, and in specific cases longer.

 

Article 19. Intellectual property

19.1. All intellectual property rights relating to the website, texts, images, product information, logos, designs and other content of TS Supplies are vested in TS Supplies and/or its licensors, unless stated otherwise.

19.2. Without prior written consent from TS Supplies, it is not permitted to copy, reproduce, publish, distribute or otherwise use content from the website in whole or in part, except for personal and non-commercial use, unless mandatory law provides otherwise.

19.3. Brand names, product names, product photographs and product descriptions of third parties remain the property of the respective rights holders.

Article 20. Complaints procedure

20.1. Complaints about the performance of the contract or about a product must be submitted to TS Supplies within a reasonable period after the consumer has discovered the defect or problem, fully and clearly described, via info@ts-shootingsupplies.com.

20.2. TS Supplies shall confirm receipt of the complaint as soon as possible and aims to provide a substantive response within 14 days. If more time is needed, the consumer will receive a message within that period indicating the next steps.

20.3. Submitting a complaint does not suspend payment obligations, unless mandatory law or TS Supplies determines otherwise in writing.

20.4. This article does not affect the consumer's right to submit a dispute to the competent court or other competent body.

Article 21. Governing law and competent court

21.1. All contracts between TS Supplies and the consumer are governed by Dutch law.

21.2. If the consumer resides outside the Netherlands, the mandatory consumer protection rules of the country of the consumer's habitual residence remain applicable insofar as these cannot be derogated from under the applicable rules of private international law.

21.3. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law grants the consumer the right to submit the dispute to the competent court of the consumer's place of residence.

Artikel 2. Definities

In deze algemene voorwaarden wordt verstaan onder:

2.1. Consument: de natuurlijke persoon die niet handelt voor doeleinden die verband houden met zijn handels-, bedrijfs-, ambachts- of beroepsactiviteit.

2.2. Overeenkomst: iedere overeenkomst op afstand tussen TS Supplies en de consument die via de webshop of anderszins op afstand tot stand komt.

2.3. Product(en): alle zaken en (indien van toepassing) digitale inhoud of aanverwante diensten die TS Supplies aanbiedt.

2.4. Herroepingsrecht: de wettelijke mogelijkheid van de consument om binnen de bedenktijd de overeenkomst op afstand te ontbinden.

2.5. Speciaal bestelde producten: producten die op verzoek van de consument afzonderlijk worden ingekocht of besteld buiten de reguliere voorraadvoering. Dit betekent niet automatisch dat het herroepingsrecht is uitgesloten; dat hangt af van de wettelijke uitzonderingen.

2.6. Dual-use goederen: goederen, software en technologie die zowel civiel als militair of anderszins gereguleerd kunnen worden gebruikt, zoals bedoeld in toepasselijke wet- en regelgeving.

Artikel 3. Toepasselijkheid en taal

3.1. Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten tussen TS Supplies en consumenten.

3.2. TS Supplies verkoopt uitsluitend aan consumenten. TS Supplies mag bestellingen weigeren of annuleren indien redelijkerwijs blijkt of vermoed wordt dat de bestelling zakelijk/B2B is, of dat niet aan deze voorwaarden of toepasselijke wetgeving wordt voldaan.

3.3. Afwijkingen van deze algemene voorwaarden zijn uitsluitend geldig indien deze schriftelijk of elektronisch uitdrukkelijk door TS Supplies zijn bevestigd.

3.4. TS Supplies biedt deze algemene voorwaarden uitsluitend aan in het Nederlands en Engels.

3.5. Bij verschillen in uitleg tussen de Nederlandse en Engelse versie prevaleert de Nederlandse versie, tenzij dwingend recht anders voorschrijft.

3.6. Indien een bepaling nietig of vernietigbaar blijkt, blijven de overige bepalingen onverminderd van kracht. TS Supplies en consument zullen dan een vervangende bepaling toepassen die zoveel mogelijk aansluit bij doel en strekking van de oorspronkelijke bepaling.

Artikel 4. Aanbod en productinformatie

4.1. TS Supplies besteedt zorg aan een zo volledig en nauwkeurig mogelijke omschrijving van producten, inclusief afbeeldingen, specificaties en toepasselijke beperkingen.

4.2. Afbeeldingen, kleuren, maten, technische specificaties en productomschrijvingen op de website zijn indicatief. Kennelijke vergissingen, typefouten, prijsfouten of technische fouten binden TS Supplies niet.

4.3. Aanbiedingen gelden zolang de voorraad strekt, tenzij uitdrukkelijk anders vermeld.

4.4. TS Supplies mag aanbiedingen wijzigen of intrekken indien sprake is van kennelijke fouten, onjuiste prijsvermelding, voorraadfouten, technische storingen of gewijzigde wettelijke beperkingen.

4.5. Voor bepaalde producten kunnen aanvullende wettelijke beperkingen, exportregels, eindgebruiksbeperkingen of vergunningsvereisten gelden. TS Supplies mag deze informatie opnemen op productpagina's, maar het ontbreken van een vermelding betekent niet dat dergelijke regels niet van toepassing zijn.

Artikel 5. Totstandkoming van de overeenkomst en verificatiecontroles

5.1. De overeenkomst komt tot stand op het moment dat TS Supplies de bestelling van de consument per e-mail bevestigt (orderbevestiging), dan wel op andere ondubbelzinnige wijze accepteert.

5.2. TS Supplies kan een bestelling voor aanvaarding weigeren of na aanvaarding opschorten/corrigeren indien: a. het product niet (meer) beschikbaar is;

b.    sprake is van een kennelijke fout in prijs, specificatie of beschikbaarheid;

c.    wettelijke of compliance-beperkingen levering verhinderen;

d.    de consument niet voldoet aan betalingsverplichtingen;

e.    er gegronde redenen zijn om misbruik, fraude, sanctie- of exportrisico's te vermoeden;

f.     de bestelling feitelijk een zakelijke bestelling betreft.

5.3.              TS Supplies may perform verification checks (TS Supplies kan verificatiecontrolesuitvoeren). TS Supplies kan daarbij, voor zover redelijk en wettelijk toegestaan, aanvullende informatie of documentatie opvragen, zoals identiteit-, leverings-, eindgebruikof eindbestemmingsinformatie.

5.4.              Indien de consument de gevraagde informatie niet, niet tijdig of onvolledig verstrekt,mag TS Supplies de uitvoering van de overeenkomst opschorten of de bestelling weigeren/cancellen.

5.5.              TS Supplies is niet verplicht om de inhoud van compliance-signalen,screeningsresultaten of risicobeoordelingen volledig toe te lichten, voor zover dit de effectiviteit van controles, wettelijke verplichtingen of veiligheidsbelangen kan schaden.

5.6.              Speciaal bestelde producten kunnen na acceptatie door TS Supplies mogelijk niet meervoor verzending kosteloos worden geannuleerd. TS Supplies zal per geval aangeven of annulering nog mogelijk is en onder welke voorwaarden, met inachtneming van het wettelijke herroepingsrecht na levering indien dat van toepassing is.

Artikel 6. Prijzen, kosten en betaling

6.1. Alle prijzen op de website zijn vermeld in euro's (EUR) en inclusief btw, tenzij uitdrukkelijk anders vermeld.

6.2. Verzendkosten, eventuele betaaltoeslagen (indien toegestaan) en overige kosten worden voor het plaatsen van de bestelling duidelijk aan de consument getoond.

6.3. TS Supplies accepteert de volgende betaalmethoden (voor zover op de website aangeboden): iDEAL (via Mollie), creditcard, PayPal en bankoverschrijving.

6.4. TS Supplies accepteert geen contante betalingen.

6.5. TS Supplies mag aanvullende voorwaarden stellen aan bepaalde betaalmethoden, zoals adresverificatie, extra controle of betaling voorafgaand aan verzending.

6.6. Indien een betaling wordt teruggedraaid, geweigerd of frauduleus blijkt, mag TS Supplies de levering opschorten of de overeenkomst ontbinden, onverminderd overige rechten.

Artikel 7. Levering, levertermijnen en leveringsgebied

7.1. TS Supplies levert vanuit Nederland.

7.2. TS Supplies levert binnen Nederland en (voor zover aangeboden) binnen de Europese Unie. TS Supplies kan het leveringsgebied op ieder moment beperken of uitbreiden.

7.3. TS Supplies may limit delivery territories and communicates available destinations on the website (TS Supplies kan levergebieden beperken en communiceert beschikbare bestemmingen op de website).

7.4. Indien levering buiten de EU in de toekomst wordt aangeboden, kunnen aanvullende voorwaarden gelden, waaronder douaneformaliteiten, invoerbeperkingen, exportvergunningen, eindgebruikersverklaringen, belastingen, invoerheffingen, lokale vergunningen of extra verificaties.

7.5. Levertermijnen zijn indicatief, tenzij uitdrukkelijk een fatale termijn schriftelijk is overeengekomen.

7.6. TS Supplies levert onverwijld en in beginsel binnen de wettelijke termijn, tenzij een andere levertermijn is overeengekomen of bijzondere omstandigheden (zoals speciale bestelling, vergunningstraject, douanecontrole of overmacht) een langere termijn rechtvaardigen.

7.7. Indien een product niet of slechts gedeeltelijk leverbaar is, stelt TS Supplies de consument hiervan zo spoedig mogelijk op de hoogte. TS Supplies kan in dat geval: (a) een alternatief product aanbieden; (b) de levering uitstellen; of (c) de overeenkomst geheel of gedeeltelijk annuleren en reeds betaalde bedragen voor het niet-geleverde deel terugbetalen.

7.8. Het risico van beschadiging of verlies van een product gaat bij consumentenkoop over op de consument op het moment van feitelijke ontvangst door de consument of een door de consument aangewezen derde (die niet de vervoerder is), tenzij de consument zelf een niet door TS Supplies aangeboden vervoerder heeft gekozen.

7.9. De consument dient het product bij ontvangst zo spoedig mogelijk te controleren op zichtbare schade of afwijkingen en eventuele problemen binnen redelijke termijn aan TS Supplies te melden.

Artikel 8. Herroepingsrecht (14 dagen)

8.1. De consument kan een overeenkomst op afstand met betrekking tot de aankoop van een product gedurende een bedenktijd van 14 dagen zonder opgave van redenen ontbinden.

8.2. De bedenktijd gaat in op de dag nadat de consument, of een door de consument aangewezen derde (die niet de vervoerder is), het product heeft ontvangen.

8.3. Tijdens de bedenktijd dient de consument zorgvuldig om te gaan met het product en de verpakking. De consument mag het product slechts gebruiken en inspecteren voor zover dat nodig is om de aard, kenmerken en werking van het product vast te stellen, zoals dat in een fysieke winkel zou mogen.

8.4. Indien de consument gebruik maakt van het herroepingsrecht, meldt de consument dit binnen de bedenktijd aan TS Supplies via een ondubbelzinnige verklaring (bijvoorbeeld per e-mail) of door gebruikmaking van het modelformulier voor herroeping (zie Bijlage 1).

8.5. De consument ontvangt na melding van herroeping, indien nodig, instructies voor de retourzending.

Artikel 9. Uitzonderingen op het herroepingsrecht

9.1. Het herroepingsrecht geldt niet voor overeenkomsten en producten waarvoor de wet een uitzondering maakt.

9.2. Voorbeelden van wettelijke uitzonderingen (voor zover van toepassing) zijn onder meer:

a.    producten die volgens specificaties van de consument zijn vervaardigd en nietgeprefabriceerd zijn, en die worden gemaakt op basis van een individuele keuze of beslissing van de consument;

b.    producten die duidelijk voor een specifieke persoon bestemd zijn;

c.    verzegelde producten die om redenen van gezondheidsbescherming of hygiene nietgeschikt zijn om te worden teruggezonden en waarvan de verzegeling na levering is verbroken;

d.    producten die na levering door hun aard onherroepelijk zijn vermengd met andereproducten;

e.    audio-, video-opnamen of computerprogrammatuur in verzegelde verpakking waarvande verzegeling is verbroken;

f.     levering van digitale inhoud die niet op een materiele drager is geleverd, indien denakoming is begonnen met uitdrukkelijke voorafgaande instemming van de consument en de consument heeft verklaard afstand te doen van het herroepingsrecht;

g.    overige wettelijke uitzonderingen zoals op dat moment geldend.

9.3. Het enkele feit dat een product 'speciaal voor u is besteld' of 'niet op voorraad was' betekent niet automatisch dat het herroepingsrecht is uitgesloten. Uitsluiting geldt alleen indien daadwerkelijk aan een wettelijke uitzondering is voldaan.

Artikel 10. Retourneren, waardevermindering en terugbetaling

10.1. Na herroeping dient de consument het product onverwijld, en in ieder geval binnen 14 dagen na de herroepingsmelding, retour te zenden of te overhandigen aan TS Supplies.

10.2. Tenzij TS Supplies uitdrukkelijk anders aangeeft, komen de rechtstreekse kosten van retourzending voor rekening van de consument.

10.3. Retourzending geschiedt voor risico van de consument totdat TS Supplies het product heeft ontvangen. TS Supplies adviseert een verzendmethode met track & trace te gebruiken.

10.4. De consument dient het product, voor zover redelijkerwijs mogelijk, te retourneren in de originele verpakking inclusief toebehoren, handleidingen en meegeleverde onderdelen. Ontbrekende of beschadigde verpakking leidt niet automatisch tot verval van het herroepingsrecht, maar kan wel van belang zijn voor de beoordeling van waardevermindering.

10.5. De consument is alleen aansprakelijk voor waardevermindering van het product die het gevolg is van gebruik van het product dat verder gaat dan nodig is om de aard, kenmerken en werking daarvan vast te stellen.

10.6. TS Supplies betaalt alle van de consument ontvangen betalingen met betrekking tot het herroepen product terug, inclusief de standaard leveringskosten van de heenzending (voor zover wettelijk vereist), onverwijld en uiterlijk binnen 14 dagen na de dag waarop TS Supplies de herroeping heeft ontvangen.

10.7. TS Supplies mag wachten met terugbetaling totdat: (a) het product retour is ontvangen; of (b) de consument heeft aangetoond dat het product is teruggezonden, afhankelijk van welk tijdstip eerst valt.

10.8. Indien de consument uitdrukkelijk heeft gekozen voor een duurdere wijze van levering dan de door TS Supplies aangeboden goedkoopste standaardlevering, hoeft TS Supplies de bijkomende kosten voor de duurdere levering niet terug te betalen.

10.9. TS Supplies kan per bestelling uit coulance (een deel van) retourkosten vergoeden. Dit schept geen recht voor toekomstige bestellingen.

10.10. Indien een retour betrekking heeft op non-conformiteit of een fout van TS Supplies, komen redelijke retourkosten voor rekening van TS Supplies, voor zover wettelijk vereist.

Artikel 11. Wettelijke conformiteit, klachten over producten en herstel

11.1. TS Supplies staat ervoor in dat producten voldoen aan de overeenkomst, de redelijke verwachtingen die de consument daarvan mag hebben, en de toepasselijke wettelijke conformiteitsvereisten.

11.2. De consument wordt verzocht het product na ontvangst binnen redelijke termijn te controleren en eventuele zichtbare gebreken, transportschade of onjuistheden zo spoedig mogelijk aan TS Supplies te melden.

11.3. Een melding door de consument dient een zo duidelijk mogelijke omschrijving van het probleem te bevatten, bij voorkeur met foto's, ordernummer en contactgegevens, zodat TS Supplies de klacht kan beoordelen.

11.4. Bij een gegronde klacht over non-conformiteit zal TS Supplies, met inachtneming van de wet, zorgdragen voor kosteloos herstel of vervanging, tenzij dit onmogelijk is of niet van TS Supplies kan worden gevergd.

11.5. Indien herstel of vervanging niet mogelijk is of niet binnen een redelijke termijn plaatsvindt, heeft de consument de wettelijke rechten op prijsvermindering of ontbinding van de overeenkomst, voor zover aan de wettelijke voorwaarden is voldaan.

11.6. Indien uit onderzoek blijkt dat: (a) geen gebrek aanwezig is; (b) de klacht is veroorzaakt door onjuist gebruik, onzorgvuldig gebruik, onjuiste montage, slijtage, ongeval, externe oorzaak of niet-naleving van instructies; of (c) het gebrek buiten de wettelijke conformiteitsplicht of commerciele garantie valt, dan mag TS Supplies redelijke onderzoeks-, verzend- of behandelkosten in rekening brengen, mits vooraf of zo spoedig mogelijk daarna hierover gecommuniceerd wordt.

11.7. Dit artikel laat alle dwingendrechtelijke consumentenrechten onverlet.

Artikel 12. Commerciele garantie van fabrikant/toeleverancier

12.1. Naast de wettelijke conformiteit (artikel 11) kunnen op bepaalde producten commerciele garanties van de fabrikant of toeleverancier van toepassing zijn.

12.2. Dergelijke commerciele garanties worden door TS Supplies niet zelfstandig vastgesteld. De inhoud, duur, voorwaarden, uitsluitingen en afhandeling van die garanties zijn gebaseerd op de bepalingen van de fabrikant en/of toeleverancier.

12.3. TS Supplies zal, voor zover redelijk mogelijk, de consument informeren over de toepasselijke garantievoorwaarden indien deze bij TS Supplies bekend zijn of door de fabrikant/toeleverancier beschikbaar zijn gesteld.

12.4. Een commerciele garantie van fabrikant of toeleverancier beperkt of vervangt nooit de wettelijke rechten van de consument op grond van conformiteit.

12.5. Voor garantieafhandeling kan TS Supplies de consument verzoeken het product ter inspectie aan te bieden of een RMA-/retourprocedure te volgen.

Artikel 13. Aansprakelijkheid

13.1. TS Supplies is uitsluitend aansprakelijk voor directe schade die het rechtstreekse gevolg is van een toerekenbare tekortkoming in de nakoming van de overeenkomst, voor zover deze aansprakelijkheid niet wettelijk is uitgesloten of beperkt.

13.2. TS Supplies is niet aansprakelijk voor indirecte schade, gevolgschade, gederfde winst, gemiste besparingen, immateriele schade, bedrijfsstilstand (voor zover van toepassing) of schade door gegevensverlies, tenzij sprake is van opzet of bewuste roekeloosheid van TS Supplies of de schade voortvloeit uit dwingend recht.

13.3. TS Supplies is niet aansprakelijk voor schade die ontstaat door: (a) onjuist, onveilig of oneigenlijk gebruik van het product; (b) gebruik in strijd met instructies, waarschuwingen of toepasselijke wet- en regelgeving; (c) wijzigingen, reparaties of bewerkingen door de consument of derden zonder toestemming van TS Supplies; (d) normale slijtage of externe oorzaken.

13.4. Voor zover TS Supplies aansprakelijk is, is de aansprakelijkheid beperkt tot het bedrag dat door de aansprakelijkheidsverzekeraar van TS Supplies in het betreffende geval wordt uitgekeerd. Indien geen verzekeringsuitkering plaatsvindt, is de aansprakelijkheid beperkt tot het door de consument voor het betreffende product betaalde bedrag, tenzij dwingend recht anders bepaalt.

13.5. De beperkingen in dit artikel gelden niet voor aansprakelijkheid wegens: (a) opzet of bewuste roekeloosheid van TS Supplies; (b) overlijden of letselschade; (c) productaansprakelijkheid voor zover dwingend wettelijk van toepassing; (d) andere aansprakelijkheid die naar dwingend recht niet mag worden uitgesloten of beperkt.

13.6. Voor vertragingen, weigeringen of annuleringen die voortvloeien uit exportcontrole, sanctieregels, vergunningsvereisten, douane- of autoriteitenbesluiten gelden artikel 14 en 15 aanvullend.

Artikel 14. Exportcontrole, sancties en compliance

14.1. TS Supplies verzendt producten vanuit Nederland en handelt in overeenstemming met toepasselijke Nederlandse, Europese en - voor zover relevant - internationale wet- en regelgeving inzake exportcontrole en sancties.

14.2. Levering aan of ten behoeve van landen, regio's, personen, entiteiten of eindgebruikers waarvoor een verbod, beperking of vergunningplicht geldt, kan geheel of gedeeltelijk worden geweigerd, opgeschort of geannuleerd.

14.3. TS Supplies hanteert geen statische lijst van bestemmingen in deze algemene voorwaarden. Sancties en exportbeperkingen wijzigen regelmatig. Daarom geldt steeds de meest actuele toepasselijke wet- en regelgeving en/of besluiten van bevoegde autoriteiten.

14.4. TS Supplies kan bij beoordeling van bestellingen gebruikmaken van screening, verificatie en risicobeoordeling, waaronder controle op: (a) bestemming en afleveradres;

(b) identiteit van koper en/of ontvanger; (c) eindgebruik en eindgebruiker; (d) productclassificatie; (e) (re-)export- of doorvoerindicaties; (f) toepasselijke sanctie- of exportrestricties.

14.5. De consument is verplicht op eerste verzoek tijdig juiste, volledige en controleerbare informatie te verstrekken die redelijkerwijs nodig is voor compliance- en exportbeoordeling.

14.6. TS Supplies mag een bestelling weigeren, opschorten of annuleren indien: (a) levering in strijd zou zijn met wet- of regelgeving; (b) een vereiste vergunning of toestemming ontbreekt, wordt geweigerd of vertraagd; (c) de consument onvoldoende informatie verstrekt; (d) TS Supplies een redelijk compliance-risico of omzeilingsrisico ziet; (e) er aanwijzingen zijn van doorverkoop, wederuitvoer of eindgebruik in strijd met toepasselijke regels.

14.7. In geval van annulering op grond van dit artikel zal TS Supplies reeds ontvangen betalingen voor het nietgeleverde product terugbetalen. TS Supplies is in dat geval, behoudens dwingend recht, niet gehouden tot vergoeding van indirecte schade of aanvullende schadevergoeding.

14.8. TS Supplies mag aanvullende voorwaarden stellen aan levering van gereguleerde of potentieel gereguleerde producten en accessoires, waaronder ondertekening van verklaringen omtrent eindgebruik, eindbestemming of wederuitvoer.

14.9. De consument is zelf verantwoordelijk voor naleving van de wet- en regelgeving in het land van bestemming en - indien van toepassing - het land van latere invoer, gebruik, wederuitvoer of overdracht.

14.10. Het feit dat een product op de website zichtbaar is of besteld kan worden, betekent niet automatisch dat levering naar iedere bestemming is toegestaan.

14.11. Verwijzingen op de website of in communicatie naar sanctielijsten, sanctiekaarten of overheidsinformatie (zoals EU/NL-bronnen) zijn informatief; de onderliggende toepasselijke verordeningen, wetgeving en besluiten van bevoegde autoriteiten zijn leidend.

Artikel 15. Dual-use, militaire goederen en vergunningen

15.1. Dit artikel is van toepassing op producten die nu of in de toekomst door TS Supplies worden aangeboden en die kunnen vallen onder regels voor: (a) dual-use goederen; (b) militaire goederen; (c) strategische goederen of diensten; (d) producten met export- of eindgebruiksbeperkingen vanuit fabrikant, toeleverancier of land van oorsprong; (e) aanverwante accessoires of onderdelen.

15.2. TS Supplies kan producten classificeren of laten classificeren op basis van informatie van fabrikant, leverancier, distributeur, importeur of bevoegde autoriteiten. Een classificatie kan wijzigen.

15.3. Voor bepaalde producten kan een exportvergunning, meldplicht of andere toestemming vereist zijn

(bijvoorbeeld via de CDIU of andere bevoegde autoriteiten). De afgifte, duur en uitkomst van dergelijke procedures liggen buiten de invloedssfeer van TS Supplies.

15.4. Eventuele levertijden voor producten waarvoor een vergunning, toetsing of aanvullende compliancecontrole nodig is, zijn uitdrukkelijk indicatief.

15.5. TS Supplies is niet aansprakelijk voor vertraging of niet-levering als gevolg van: (a) vergunningaanvragen of weigeringen; (b) aanvullende controles door Douane/CDIU of andere autoriteiten; (c) gewijzigde classificaties; (d) gewijzigde wet- en regelgeving; (e) beperkingen van fabrikant/toeleverancier of exporteur.

15.6. Indien een product of transactie (achteraf) vergunningplichtig blijkt of levering anderszins niet is toegestaan, mag TS Supplies de overeenkomst geheel of gedeeltelijk opschorten of ontbinden/cancellen.

15.7. TS Supplies kan verlangen dat de consument een (eind)gebruikersverklaring, niet-wederuitvoerverklaring of andere compliance-documentatie ondertekent of verstrekt alvorens tot levering over te gaan.

15.8. De consument verklaart producten niet te gebruiken, door te leveren, over te dragen of wederuit te voeren in strijd met toepasselijke sanctie- of exportregels, inclusief eventuele product- of fabrikantgebonden beperkingen die voor of bij levering kenbaar zijn gemaakt.

15.9. Voor zover de consument na levering zelf exporteert, overdraagt of wederuitvoert, is dat volledig de verantwoordelijkheid van de consument. De consument dient zelf na te gaan welke vergunningen, beperkingen of verboden gelden.

Artikel 16. Overmacht

16.1. TS Supplies is niet gehouden tot nakoming van enige verplichting indien nakoming wordt verhinderd door overmacht.

16.2. Onder overmacht wordt onder meer verstaan: storingen in internet of betalingsverkeer, cyberincidenten, transportproblemen, vertragingen bij leveranciers, import-/exportbeperkingen, douanecontroles, vergunningvertragingen, overheidsmaatregelen, sanctiewijzigingen, stakingen, ziekte, brand, oorlog, onlusten, natuurrampen en andere omstandigheden buiten de redelijke controle van TS Supplies.

16.3. Tijdens overmacht worden verplichtingen van TS Supplies opgeschort. Indien nakoming blijvend onmogelijk is of de overmachtssituatie onredelijk lang duurt, mag TS Supplies de overeenkomst geheel of gedeeltelijk ontbinden.

16.4. In geval van ontbinding wegens overmacht zal TS Supplies reeds ontvangen betalingen voor het nietuitgevoerde deel van de overeenkomst terugbetalen, tenzij een wettelijke uitzondering van toepassing is.

Artikel 17. Eigendomsvoorbehoud

17.1. Alle door TS Supplies geleverde producten blijven eigendom van TS Supplies totdat de consument alle verschuldigde bedragen volledig heeft voldaan.

17.2. Zolang de eigendom niet is overgegaan, mag de consument het product niet verpanden of anderszins bezwaren.

17.3. Dit artikel laat de wettelijke regels omtrent risico-overgang bij consumentenkoop onverlet.

Artikel 18. Persoonsgegevens en fiscale bewaarplicht

18.1. TS Supplies verwerkt persoonsgegevens in overeenstemming met toepasselijke privacywetgeving (waaronder de AVG/GDPR) en de op de website gepubliceerde privacyverklaring.

18.2. TS Supplies gebruikt persoonsgegevens onder meer voor orderverwerking, betaling, levering, klantenservice, klachtenafhandeling, fraudepreventie, compliance- en verificatiecontroles (waaronder export/sancties), en het voldoen aan wettelijke verplichtingen.

18.3. Voor details over categorieen persoonsgegevens, doeleinden, grondslagen, bewaartermijnen, rechten van betrokkenen en contactmogelijkheden verwijst TS Supplies naar de privacyverklaring.

18.4. TS Supplies bewaart administratieve gegevens, waaronder order- en factuurgegevens, zolang dat nodig is voor uitvoering van de overeenkomst en voor zover vereist op grond van fiscale en administratieve bewaarplichten. Voor bepaalde gegevens geldt in beginsel een wettelijke bewaartermijn van ten minste 7 jaar, en in specifieke gevallen langer.

Artikel 19. Intellectuele eigendom

19.1. Alle intellectuele eigendomsrechten op de website, teksten, afbeeldingen, productinformatie, logo's, ontwerpen en overige content van TS Supplies berusten bij TS Supplies en/of haar licentiegevers, tenzij anders vermeld.

19.2. Het is zonder voorafgaande schriftelijke toestemming van TS Supplies niet toegestaan om content van de website geheel of gedeeltelijk te kopieren, reproduceren, publiceren, distribueren of anderszins te gebruiken, anders dan voor eigen persoonlijk en niet-commercieel gebruik, tenzij dwingend recht anders bepaalt.

19.3. Merknamen, productnamen, productfoto’s en productbeschrijvingen van derden blijven eigendom van de betreffende rechthebbenden.

Artikel 20. Klachtenregeling

20.1. Klachten over de uitvoering van de overeenkomst of over een product dienen binnen redelijke termijn nadat de consument het gebrek of probleem heeft ontdekt, volledig en duidelijk omschreven te worden ingediend bij TS Supplies via info@ts-shootingsupplies.com.

20.2. TS Supplies bevestigt de ontvangst van de klacht zo spoedig mogelijk en streeft ernaar om binnen 14 dagen inhoudelijk te reageren. Indien meer tijd nodig is, ontvangt de consument binnen die termijn een bericht met indicatie van de vervolgstappen.

20.3. Het indienen van een klacht schort betalingsverplichtingen niet op, tenzij dwingend recht of TS Supplies schriftelijk anders bepaalt.

20.4. Dit artikel laat het recht van de consument om een geschil voor te leggen aan de bevoegde rechter of andere bevoegde instantie onverlet.

Artikel 21. Toepasselijk recht en bevoegde rechter

21.1. Op alle overeenkomsten tussen TS Supplies en de consument is Nederlands recht van toepassing.

21.2. Indien de consument buiten Nederland woont, blijven de dwingendrechtelijke consumentenbeschermingsregels van het land van gewone verblijfplaats van de consument van toepassing voor zover deze op grond van toepasselijk internationaal privaatrecht niet terzijde kunnen worden gesteld.

21.3. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, tenzij dwingend recht de consument

het recht geeft het geschil voor te leggen aan de bevoegde rechter van zijn/haar woonplaats.
